Terms of Service

Acceptance of Terms
By using this website and submitting a quote request, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our website.
Preliminary vs. Final Offers
All preliminary offers provided by Sell Watch OC ("SWOC," "we," "us," or "our") are free, no-obligation estimates based on the information and images you submit through our online form. A preliminary offer is not a binding purchase price. A final purchase offer is determined only after SWOC physically inspects and authenticates your watch, verifying its condition, reference, completeness, and conformity with your submission. You are under no obligation to accept any offer, preliminary or final.
Accuracy of Information
You agree to provide accurate and truthful information about your watch, including brand, model, reference number, model year, condition, and the inclusion of original box, papers, or other accessories. Misrepresentation may result in a revised or withdrawn offer. If the physical condition of your watch differs materially from your submission, SWOC reserves the right to adjust or revoke the preliminary offer.
Seller Ownership & Authority
By submitting a watch for evaluation or accepting an offer, you represent and warrant that:
- You are the legal owner of the watch or are otherwise legally authorized to sell it on behalf of the owner.
- You have the right to transfer good, marketable, and unencumbered title to the watch, free and clear of all liens, security interests, encumbrances, and adverse claims.
- The watch is not stolen, and you have no reason to believe it is stolen or was acquired through fraud or unlawful means.
- The watch is not subject to any unresolved competing ownership claims, pending litigation, or disputes of which you are aware.
SWOC may request identification, documentation, or other evidence reasonably necessary to establish your ownership and authority to sell prior to completing a transaction.
Counterfeit, Aftermarket & Altered Items
SWOC reserves the right to reject any submission or revoke any offer, preliminary or final, if the watch is found to be counterfeit, if serial numbers have been altered or removed, if the watch contains undisclosed aftermarket or non-original components, if the watch has been materially modified from its original factory configuration, or if the watch otherwise materially differs from the information and images you submitted. In such cases, SWOC may return the watch to you at your expense or, where required by law, report the item to the appropriate authorities.
Custody, Title Transfer & Risk of Loss
You retain full ownership of your watch at all times during the evaluation and inspection process. Title to the watch does not transfer to SWOC until all of the following have occurred: (1) SWOC has completed its physical inspection and authentication, (2) SWOC has presented a final purchase offer, (3) you have expressly accepted that final offer, and (4) SWOC has initiated or completed payment. Until title transfers, the watch remains your property and is returned to you if you decline the final offer.
Risk of loss during inbound insured transit to SWOC is covered under the provided shipping insurance, subject to the terms of the shipping carrier and insurance provider. Risk of loss transfers to SWOC upon SWOC's physical receipt of the watch. If you decline the final offer, risk of loss transfers back to you upon delivery of the returned watch to the shipping carrier for return transit, and the return shipment is insured as described in the Return Shipping section below.
Shipping & Insurance
SWOC provides complimentary fully insured shipping for qualifying watch submissions, protecting your timepiece while in transit to our team for inspection and authentication. The insured shipping label is provided after you receive and choose to proceed with a preliminary offer. Risk of loss during transit is covered under the provided insurance, subject to the terms of the shipping carrier and insurance provider.
Inspection & Authentication
Upon receipt, your watch undergoes a physical inspection and authentication process. SWOC verifies condition, reference, completeness, and conformity with your submission. The final purchase offer is confirmed only after this process is complete. Payment is initiated following successful inspection and authentication and upon your acceptance of the final offer.
Return Shipping If You Decline
If you decide not to sell after inspection, SWOC will return your watch. The following terms apply to return shipments:
- SWOC covers the cost of return shipping and provides fully insured return transit at no charge to you.
- The watch will be shipped to the address you provide, which must be a verifiable residential or commercial address (no P.O. boxes for insured shipments).
- A signature is required upon delivery to confirm receipt.
- Return shipments are typically initiated within two business days of your decision to decline.
- Risk of loss transfers back to you upon delivery of the returned watch to the shipping carrier.
You are not obligated to accept any offer at any stage of the process.
Payment
If you accept the final purchase offer, payment is initiated promptly via an approved payment method, typically wire transfer, cash, or crypto. The transaction closing sequence is as follows: inspection and authentication → final offer presented → seller acceptance → payment initiated → title transfers to SWOC → transaction is final, except as otherwise required by applicable law.
Independent Third-Party Transaction Option
For sellers who prefer not to ship their watch directly to SWOC, an independent third-party transaction option may be available. This option is entirely optional, subject to availability, and is provided by an independent third party that is not affiliated with or controlled by SWOC. The third party may apply separate terms, conditions, and fees. SWOC is not responsible for the acts or omissions of the third-party provider. Sellers who choose this option should review the third party's terms independently before proceeding. Sellers may also request a private in-person appointment on a case-by-case basis if they are a local seller not comfortable with a shipping transaction. Availability of all such options is determined at the discretion of SWOC.
Estates, Trusts & Probate Documentation
When selling a watch on behalf of an estate, trust, or another individual, SWOC may request identification, estate or trust documentation, letters testamentary, court orders, powers of attorney, or other evidence reasonably necessary to establish your ownership and authority to sell. SWOC may decline to complete a purchase if sufficient documentation is not provided.
Disputed Ownership Policy
SWOC will not knowingly complete a purchase while the ownership of or authority to sell a watch is disputed. If SWOC becomes aware of a competing ownership claim, pending litigation, lien, or other encumbrance, SWOC may suspend or cancel the transaction, hold the watch pending resolution, or return the watch to the seller, in SWOC's discretion and as permitted by law.
Service Area
SWOC is a mail-in watch buyer serving all of Orange County, California. Online quote requests are accepted 24/7. Private appointments for local sellers are available on a case-by-case basis.

Limitation of Liability
To the fullest extent permitted by applicable law, SWOC shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for any loss of profits, lost opportunities, or diminution in value, arising out of or relating to your use of this website, the submission of a watch for evaluation, or any transaction with SWOC. Except for SWOC's gross negligence, willful misconduct, or breach of its core obligations regarding the physical custody of your watch while in SWOC's possession, SWOC's total aggregate liability arising out of or relating to any transaction shall not exceed the final purchase offer amount presented to you for the watch in question, or the fair market value of the watch at the time of submission, whichever is less.
You acknowledge that luxury watches are high-value items and that SWOC takes reasonable precautions to safeguard watches in its custody, including insured shipping and secure handling. SWOC's liability for loss of or damage to a watch while in SWOC's physical custody or insured transit is limited to the coverage provided under the applicable shipping insurance policy or SWOC's own insurance, as applicable. SWOC is not an insurer and does not guarantee the safety of any item beyond the coverage provided under such policies. You are encouraged to maintain your own insurance coverage on any watch until title transfers to SWOC.
SWOC is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, shipping carrier delays or failures, labor disputes, governmental actions, or failures of third-party service providers.
Seller Indemnification
You agree to indemnify, defend, and hold harmless SWOC, its officers, employees, agents, and affiliates from and against any and all claims, demands, suits, actions, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Any misrepresentation, whether intentional or negligent, regarding the watch's brand, model, reference, condition, authenticity, completeness, provenance, or any other material fact
- Any breach of the seller warranties and representations set forth in these Terms, including the Seller Ownership & Authority section
- Any claim by a third party asserting ownership, lien, security interest, or other encumbrance on the watch, or disputing your authority to sell it
- Any fraud, theft, or illegal activity connected with the acquisition or submission of the watch
- Any counterfeit, altered, or materially modified watch submitted to SWOC, including any costs incurred by SWOC in investigating, returning, or reporting such items
- Any dispute among heirs, beneficiaries, spouses, co-owners, or other parties claiming an interest in the watch
- Any failure to disclose known defects, liens, competing claims, or other material information about the watch
This indemnification obligation survives the completion or termination of any transaction with SWOC. SWOC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with SWOC in asserting any available defenses. You may not settle any matter without SWOC's prior written consent.

You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
Changes to These Terms
We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the website after any changes constitutes acceptance of the revised Terms.
